Terms of Service and Disclaimer

“FCC Action Notice” notifications are provided via email from information publicly available on the Federal Communication Commission’s (“FCC”) Broadcast Radio and Television Electronic Filing System (“CDBS”) on an “as available” basis to subscriber’s email addresses as listed in FCC applications.  The subscriber is responsible for notifying “FCC Action Notice” of subscriber domain names and/or email addresses used by the subscriber in FCC applications.  

No warranty of any kind is made to the subscriber or any other person with regard to the sending, receipt or delivery of such notifications or the information contained within. The subscriber, by subscribing to “FCC Action Notice”, accepts the responsibility to confirm directly with the FCC through its CDBS or otherwise prior to relying upon any information contained in a “FCC Action Notice” notification. 

The information contained in a “FCC Action Notice” notification is FCC CDBS information for one moment in time.  Subsequent changes may take place to such FCC CDBS information and any responsibility whatsoever for any subsequent notifications regarding changes of information whether adverse or otherwise is disclaimed. 

There are many factors that may delay notices, cause incorrect information or cause notices not to be sent or delivered including computer, network or internet outages and malfunctions, incorrect, erroneous, missing, non-recognized or multiple email addresses in FCC applications, human errors, program errors or bugs, viruses, HTML and attachment stripping and blocking, and email bounces or non-delivery due to spam control measures.  The subscriber, by subscribing to “FCC Action Notice”, affirms that there shall be no liability for any factor causing incorrect information in, or non-delivery or misdelivery of, “FCC Action Notice” notifications whether or not such factor is within or outside of any person’s or entity’s control and whether or not such factor was or could have been foreseen or prevented. 

“FCC Action Notice” notifications may not be sent for reasons such as, among other reasons, CDBS is reflecting an FCC application that was not filed electronically even though it may appear in CDBS, an FCC application was not acted upon in the routine course or acted upon multiple times in one day, or an FCC application was pending for more than five years. 

The sole liability for any “FCC Action Notice” email that is not sent or received, contains incorrect information, or is sent in excess of one business day after the FCC CDBS publicly reflects action on the subject application (i.e. CDBS reflects action taken on a Wednesday and an “FCC Action Notice” notification is not sent until Friday or later), or for any other unsatisfactory aspect of a “FCC Action Notice” notification, is a refund or credit to the subscriber of any pro-rata or unit charge assessed for that particular “FCC Action Notice” notification. 

These terms of service may be amended, modified or changed at any time and “FCC Action Notice” service may be cancelled or discontinued at any time with or without notice.
